Perfil académico profesional de la carrera de Derecho.

Abstract

El objetivo central de este informe es elaborar una propuesta del perfil académico profesional de la carrera de Derecho, que responda a las necesidades de un nuevo plan de estudios y se ajuste no solo a las "exigencias" de la sociedad, sino que también favorezca la proyección, de esta disciplina, hacia la sociedad. Esta tarea se realizó en tres etapas. Durante la primera etapa se diagnosticaron las necesidades curriculares de la carrera y se elaboró un documento base como propuesta sobre los componentes del perfil. En la segunda etapa se realizaron una serie de talleres en los que autoridades, docentes, estudiantes, profesionales en servicio, representantes de entes empleadores y del colegio profesional de esta disciplina opinaron sobre el documento base y aportaron sus propias 26 ideas. Finalmente, en la tercera etapa se confeccionó el documento final. Este documento incluye un marco referencial en el que se exponen los antecedentes históricos (origen y desarrollo de la carrera) que permiten conocer qué tipo de profesional se ha formado y cuál ha sido la relación universidad-sociedad a través del tiempo. También brinda una justificación sobre el ideal de una carrera universitaria. En el marco conceptual se define cuál es el objeto de estudio de la carrera de Derecho y también se definen los conceptos de ser humano, de sociedad y del proceso de enseñanza-aprendizaje. En lo que concierne a los componentes del perfil profesional, estos se estructuran en tres áreas: la académica, que incluye los conocimientos, las habilidades y las destrezas; la personal, constituida por los valores y las actitudes, y la laboral, conformada por las funciones y las tareas. También se exponen los objetivos del plan de estudios, los cuales determinan dos aspectos fundamentales, a saber, la estructura curricular y la propuesta programática de los cursos. Entre las conclusiones, se presenta la necesidad de formar a un abogado jurista que conozca de otras disciplinas, en contraposición al abogado litigante que históricamente se ha formado y que no conoce la interdisciplinariedad dentro de su campo. Además, se afirma la urgencia de reformar las bases filosóficas y epistemológicas de esta carrera, así como también deben implementarse nuevas estrategias metodológicas en el proceso enseñanza-aprendizaje. Finalmente, se expone una serie de problemas que presenta el curriculum vigente a la fecha en que se realizó el estudio.

ABSTRACT: The main objective of this paper is to develop a proposal for the professional academic profile of the law degree, which responds to the needs of a new plan study and is adjusted not only to the "demands" of society, but also it favors the projection of this discipline towards society. This study was carried out in three stages. During the first stage, the curricular needs of the career were diagnosed and a base document was prepared as a proposal on the profile components. In the second stage, a series of workshops will be held in which authorities, teachers, students, service professionals, representatives of related entities and the professional association of this discipline gave their opinion on the base document and contributed their own 26 ideas. Finally, in the third stage, a final document was prepared. This final document includes a referential framework in which the historical antecedents (origin and career development) are exposed, which allow knowing what type of professional has been trained and what the university-society relationship has been over the time. We also provide a rationale for the ideal of a college career. In the conceptual framework, the object of study of the Law degree is defined, and the concepts of human being, society and the teaching-learning process are also defined. With regard to the components of the professional profile, these are structured in three areas: the academic one, which includes knowledge, abilities and skills; the personal one, made up of values ​​and attitudes, and the labor one, made up of functions and tasks. The objectives of the study plan are also exposed, which determine two fundamental aspects, such us, the curricular structure and the programmatic proposal of the courses. Among the conclusions, there is a need to train a legal lawyer who knows other disciplines, as opposed to the trial lawyer who has historically been trained and who does not know interdisciplinarity within his field. In addition, it affirms the urgency to reform the philosophical and epistemological bases of this career, as well as they must also implement new methodological strategies in the teaching-learning process. Finally, a series of problems are presented in the study plan in force at the date the study was conducted.
